Redemption of mortgage only before sale The Supreme Court ruled last week that a mortgage can be redeemed before the date fixed for sale or transfer by the secured creditor, but not after that. “It is only where the dues of the secured creditor are tendered together with costs, charges and expenses before the date fixed for sale that the secured assets are not to be sold or transferred,” the court stated in its judgment in the case, Dwarika Prasad vs State of Uttar Pradesh.
